Daniel B. McMahon is a member of the Plunkett Cooney’s Banking, Bankruptcy & Creditors’ Rights Practice Group. He focuses his practice in the areas of loan workouts and foreclosures, bankruptcy, commercial real estate, loan documentation and construction loans.

Prior to joining the firm, Mr. McMahon worked approximately 30 years for LaSalle Bank Corporation, formerly known as Michigan National Corporation as the First Vice President/ Senior Counsel. He represented commercial lenders and workout groups of middle and small business loans, involving troubled credit, litigation, bankruptcy and transactional loan documentation.

Mr. McMahon was instrumental in establishing the bank’s full service law department for Southeast Michigan, where he developed the department’s competencies in commercial loan documentation, bank services and regulatory functions.

A frequent lecturer on various banking issues, Mr. McMahon is a member of the State Bar of Michigan’s Real Estate Law Section and Pro Bono Committee. He is also a member of the Birmingham Brownfield Redevelopment Committee, as well as a volunteer pro bono attorney with Community Legal Resources.

Representative Client Work

  • Represented a lender in a multi-million dollar recovery in a priority dispute against a competing secured lender
  • Represented a lender in the defense of an $8 million preference action brought by Unsecured Creditors Trust claimants
  • Successfully represented a mortgage lender in the restructure and resolution of several real estate projects involving issues of construction liens, incomplete construction, construction defects and construction loan defaults 
  • Represented a lender in the foreclosure of a large commercial real estate development, litigation over foreclosure and deficiency issues, disposition of the project and collection of deficiency balance
  • Successfully defended a construction lender against a series of claims brought by the borrower and construction subcontractors alleging obligations by the lender for negligent construction lending, funding and oversight
  • Structured and drafted documents for a $6 million land development and construction loan for a residential construction project
