Elaine M. Pohl is a partner in the firm’s Bloomfield Hills office who focuses her practice on liquor licensing matters and insurance coverage law.
A member of Plunkett Cooney’s Foodservice & Hospitality Industry Group, Ms. Pohl has extensive experience representing grocery and convenience stores, bars, restaurants, brewpubs and other hospitality industry clients with respect to Michigan liquor licensing issues.
This aspect of her practice includes representing new and existing businesses in liquor license transfers, specifically through the application process with the Michigan Liquor Control Commission. Ms. Pohl’s experience also extends to representing liquor licensees at administrative hearings when violations of the Michigan Liquor Control Code or administrative rules are alleged.
Another key aspect of Ms. Pohl’s practice involves the representation of creditors, including landlords and lenders, in obtaining and perfecting security interests in liquor licenses and enforcing those interests upon default. Ms. Pohl has served as Michigan counsel for national clients who have liquor license needs within the state.
Ms. Pohl also has experience in general litigation matters and advises insurance company clients on complex insurance coverage issues, primarily advising insurance companies on complex coverage questions and representing them when disputes arise.
Representative Work
- Represented national convenience store chain in all aspects of Michigan liquor licensing, including liquor license application approvals and violation hearings before the Michigan Liquor Control Commission
- Spearheaded complex liquor license transfer project for national drug store chain, affecting stores throughout the state of Michigan
- Prepared management agreement for receiver to continue operation of hotel’s liquor license
- Represented bank in enforcing security interest against liquor licensee in default, including assistance in transferring license to new purchaser
- Represented regional micro brewer in obtaining approval for new liquor license
