Plunkett Cooney represents its clients in class actions, multi-party and individual property and personal injury claims resulting from fires and explosions in residential, commercial and industrial settings. Many of these cases involve product defect and general negligence theories, involving property damage or the serious injury or death of individuals.
In the area of product liability, our attorneys defend manufacturers and sellers of a multitude of products, including space heaters, paper shredders, consumer electronics, fire suppression systems and motor vehicles. Our attorneys are also frequently called upon to defend litigation involving property owners and claims occurring within the construction setting. These claims are often high-profile with exposures in the multi-million dollar range.
Our attorneys are well versed in all aspects of the National Fire Protection Association (NFPA 921) code for fire investigation, and they have successfully argued motions in Daubert and evidentiary hearings to address such key issues as spoliation of evidence and the reliability and admissibility of purported experts’ theories of causation.
The firm’s fire loss practice extends nationally in both state and federal court jurisdictions. In addition to serving as regional and national coordinating counsel for fire claims, our attorneys are members of “first responders” teams designed to arrive at the scene of a fire quickly in order to assess the situation, advise clients on the ground, investigate causation and preserve evidence for potential, future litigation.
