Webinar Overview:

The lateral is one of the most dynamic plays in football. It entails pitching the ball to someone behind you to avoid defenders and advance down the field.

Fundamentally, that is what the tender of defense is – handing off your defense and indemnity duties to another party. Like the lateral, this concept is intended to score in the litigation context as well.

Indemnification and the tender of defense to a third party are two of the most effective ways to transfer your business liability to another party. For instance while a property owner is the most likely target for claims of defective premises, there are any number of contractors, suppliers and partners who may contractually or otherwise be obligated to defend and indemnify that owner .

This webinar explored these methods for tendering your defense contractually or by the operation of law. Our attorneys examined what property owners and operators can do to protect their business interests through the use of indemnity agreements and tendering the defense of litigation to the insurance providers of related parties.
