Paul J. Dwaihy, a partner in the firm's Detroit and Petoskey offices, concentrates his practice on defending medical liability litigation. Mr. Dwaihy represents physicians, hospitals, nursing homes and other healthcare providers in medical malpractice actions throughout Michigan. Mr. Dwaihy also has experience representing healthcare providers in state licensing actions.

Representative Client Work

  • Obtained dismissal of major local hospital in wrongful death case in which the plaintiff alleged psychiatric malpractice resulting in premature discharge from hospital and suicide
  • Obtained dismissal of family practitioner in wrongful death case in which the plaintiff alleged failure to diagnose lung cancer
  • Obtained dismissal of two internists in wrongful death case where the plaintiff alleged failure to properly diagnose and treat decubitus ulcers leading to sepsis
  • Obtained dismissal of internist in wrongful death case involving allegations of improper management of bed rails which led to asphyxiation and death of nursing home resident
  • Successfully defended to no cause for action a wrongful death claim against a surgeon alleging failure to timely repair an abdominal aortic aneurysm
  • Successfully defended to no cause for action claims against an obstetrician/gynecologist and hospital alleging improper repair of an obstetrical laceration leading to recto-vaginal fistula
  • Successfully defended to no cause for action a claim against a vascular surgeon alleging improper management of a wound infection resulting in death
  • Successfully defended to no cause for action a claim against a vascular surgeon alleging failure to diagnose occluded aorta leading to leg amputation
  • Successfully defended to no cause for action a claim against an orthopedic surgeon alleging patient abandonment and failure to diagnose post-operative infection
  • Successfully defended to no cause for action a general negligence claim against a corporate client alleging the collapse of an examination table caused traumatic brain injury
  • Successfully defended to no cause for action a claim against a vascular surgeon alleging improper repair of an abdominal aortic aneurysm
  • Successfully defended to no cause for action a claim against a family practitioner for failure to diagnose appendicitis resulting in ICU psychosis 
  • Successfully defended to no cause for action a claim against a radiologist for failure to diagnose vascular ring in a pediatric patient
  • Successfully defended to no cause for action a claim against a cosmetic surgeon for improper performance of a breast augmentation procedure
  • Successfully defended to no cause for action a claim against a medical technician alleging burns from a cosmetic laser procedure
  • Obtained dismissal of a family practitioner after successfully attacking plaintiff's causation theory at a Daubert hearing in an alleged failure to diagnose skin cancer case
  • Successfully represented pediatrician in state licensing investigation regarding alleged HIPAA violation. The investigation was dropped with no action taken against the physician's license.
  • Obtained reversal of summary suspension order, reinstating in full a family practitioner's medical license in a state licensing matter
