Bio

Stephanie M. Brochert is a member of the firm's Bloomfield Hills office, practicing primarily in the area of insurance coverage.

Ms. Brochert represents regional, national and international insurance companies in coverage cases throughout the United States, and she is admitted to practice law in Michigan, New York and New Jersey. She advises and represents her clients on a variety of issues, including construction defect, premises liability and long-tail environmental claims.

Prior to joining the firm, Ms. Brochert worked as an in-house litigation attorney for a global property restoration company where she handled matters across the country alleging construction defect and warranty issues, toxic tort, personal injury and premises liability, as well as disputes over insurance coverage and contractual indemnity between contractors.  Before that, Ms. Brochert practiced for several years with a New York City metro-area law firm where she represented insurers in complex coverage disputes involving multi-million dollar construction projects, severe personal injuries and exposures to toxic materials, as well as matters involving state and local government entities, including the city of New York.

Representative Client Work

  • Advised insurer on coverage issues arising from multi-million dollar lawsuit against manufacturers and distributors of opioids
  • Drafted an analysis of major decisions rendered by courts around the country in 2020 relating to long-tail environmental liability claims at the special request of a Tier 1 insurer client
  • Contributing author and editor of the ALFA International Insurance Compendium for the state of Michigan
  • Successfully represented insurers against claims of additional insured coverage where policy endorsement significantly narrowed the scope of coverage from the standard policy form
  • Assisted in obtaining summary judgment in insurer’s favor, finding no breach of insurance contract for denial of workers' compensation benefits where insured began operating in second state without informing insurer
  • Obtained summary dismissal of a coverage claim against an insurer, successfully arguing that an insured’s motorized bicycle was an “auto” that was precluded from coverage under the insured’s general liability policy
  • Frequently advises insurer clients on defense and indemnity obligations for cases involving policies issued to municipal or quasi-municipal entities
  • Obtained summary dismissal of claims against a property insurer because the damages alleged by the property owner were excluded “faulty workmanship” under the policy
  • Advised insurer on indemnity obligations for multimillion-dollar verdict against insured in a construction defect case in which master policy was originally issued in a European country
  • Successfully prosecuted motions to compel documents and corporate witness testimony in cases alleging bad faith against an insurer
  • Successfully represented insurers seeking to rescind policies on the basis that the insured provided materially misrepresentative statements on the application for insurance
  • Advised insurer on defense and indemnity obligations relating to opioid lawsuits
  • Represented insurers in summary motion practice dealing with alleged wrongful withdrawal of a defense where the insured failed to cooperate with its defense counsel
  • Obtained summary dismissal of a coverage action based on New York Insurance Law 3420’s requirement that a denial of coverage be given as soon as reasonably possible, where an injured claimant alleged not to have received a copy of the disclaimer but the same was properly mailed under applicable law
