Bio

Scott W. Malott is a Co-leader of Plunkett Cooney's Transportation Law Practice Group who focuses his practice on insurance-related claims involving no-fault law, motor vehicle negligence, premises liability and property liability, including theft and damage.

A partner in the firm's Bloomfield Hills office, Mr. Malott handles cases and pre-litigation investigations involving a broad array of insurance matters, ranging from potentially high-exposure litigation involving complex and catastrophic injuries to comparatively low-exposure theft or fraud claims. He serves as approved panel counsel for numerous national insurance companies.

Mr. Malott received his law and undergraduate degrees from Western Michigan University in 2011 and 2004, respectively. He is admitted to practice in state and federal courts in Michigan and is a member of the State Bar and the Oakland County Bar Association.

Representative Client Work

  • Successfully defended a fraudulent auto theft claim through jury verdict, finding that plaintiff had no cause of action
  • Secured dismissal of an action seeking PIP benefits by an individual plaintiff and multiple intervening provider plaintiffs due to the plaintiff's violation of her policy’s concealment and fraud provision
  • Defended numerous cases involving a now-closed treatment facility guilty of utilizing unlicensed and inadequately supervised personnel to provide unreasonable and unnecessary cognitive rehabilitation services to insureds following minor motor vehicle accidents
  • Successfully defends litigated claims through consistent and appropriate motion practice, including securing dismissals when plaintiffs and/or their counsel refuse to cooperate
  • Regularly assists clients with the investigation and defense of claims where one or more NICB indicators of potential fraud are present, including irregularities in medical treatment and billing, extensive or unnecessary treatment for minor, subjective injuries, and utilization of what appear to be templated medical treatment notes, among others
