Hopey A. Gardner is an associate attorney in the firm's Torts and Litigation Practice Group. She maintains a diverse litigation practice that includes the areas of business law, insurance coverage and general litigation.

A member of Plunkett Cooney’s Indianapolis office, Ms. Gardner’s litigation expertise encompasses numerous areas, ranging from bankruptcy to construction defect and environmental liability. Other areas of expertise include personal injury claims related to trucking and transportation matters and workers' compensation claims.

Ms. Gardner is admitted to practice in Indiana, Illinois and Missouri. Her experience includes trials, small claims disputes and arbitrations, experience she gained while working as an attorney for several national insurance companies and while in private practice.

Representative Client Work

  • Obtained summary judgment, which was upheld on appeal, for a major national carrier after successfully arguing applicability of insurance policy exclusion in a trucking liability case
  • Obtained favorable verdict on behalf of an insured homeowner following a jury trial with an award issued that was less than 10% of the settlement offer at mediation
  • Drafted policy provisions regarding salvage vehicle titles and coverage for an insurance carrier client
  • Drafted a complete self-insurance document for a state governmental agency regarding all agency automobile use
  • Obtained summary judgment on a sovereign immunity issue for a school district in a case involving multiple fatalities where plaintiffs claimed damages in the millions
  • Successfully argued coverage issues and negotiated nuisance value settlement in a case involving allegations of child abuse and resultant fatality at an in-home daycare facility
  • Obtained summary judgment on behalf of defendant in multi-million-dollar product liability case involving a paraplegic plaintiff and multiple co-defendants
