Bio
James L. Frisch is a member of Plunkett Cooney’s Medical Litigation Practice Group who concentrates his practice primarily in the area of medical malpractice defense.
Mr. Frisch represents health care organizations and private practice professionals in complex medical malpractice claims and other personal injury and insurance claims throughout Michigan. These matters include alleged professional liability in cases involving birth trauma, cardiac arrest, missed diagnoses, death, state licensing and regulatory matters.
Mr. Frisch also has experience with first- and third-party motor vehicle negligence matters, having previously served as in-house counsel for a national auto insurer. He represented various insurance companies against auto insurance claims directly and as assigned carriers through the Michigan Automobile Insurance Placement Facility (MAIPF). In addition, Mr. Frisch has represented clients in complex trust and estate litigation, guardianship issues and conservatorship matters.
While in law school, Mr. Frisch served as a judicial clerk for the Honorable Linda S. Hallmark at the Oakland County Probate Court. Prior to entering law school, Mr. Frisch worked as an Arson Fraud Unit Intern at the Wayne County Prosecutor’s Office in Detroit, as a level II trauma hospital emergency room paramedic, and as a paramedic for a private EMS company.
Representative Client Work
- Obtained dismissal of first-party claims in a No-Fault auto liability action where the court granted summary disposition, holding the plaintiff committed fraud. All claims were dismissed against the insurer with prejudice.
- Obtained dismissal of economic damages in a medical malpractice, wrongful death action. The court granted partial summary disposition, holding the plaintiff’s claims for lost earning capacity pursuant to Daher v Prime Healthcare Servs- Garden City, LLC.
- Obtained dismissal of orthopedic surgeon in an action alleging failure to properly perform knee examination, causing injury
- Obtained dismissal of hospital physician in an action alleging failure to timely recognize and treat aspirational pneumonia following a total knee replacement
