Rochelle L. Clarke serves as Co-Leader of the firm's Governmental Law Practice Group, and she is a member of Plunkett Cooney's Medical Litigation and Employment Law practice groups. Her practice is focused primarily on the defense of litigation in the areas as municipal, education, medical and professional liability.
Ms. Clarke's clients include physicians and other health care providers involved in medical malpractice litigation and municipalities involved in a range of litigation, including claims of alleged police misconduct and other claims brought in state and federal court.
Ms. Clarke received her law degree, cum laude, from Michigan State University College of Law in 2014. While there, she traveled to London to participate in a legal services market study in the wake of deregulation and technological innovation. She also served as an editorial associate for the college's Journal of Medicine and Law. Ms. Clarke received her undergraduate degree from the University of Michigan in 2011.
Representative Client Work
Successfully represented municipal officials in federal court action with regard to employment discrimination claims brought as a result of an alleged wrongful termination. Summary judgment was granted as to each count of plaintiff’s complaint.
Successfully represented a school district in state court action involving alleged violations of the Michigan Elliott Larsen Civil Rights Act. Summary disposition was granted and plaintiff’s complaint was dismissed in its entirety.
Obtained summary disposition of all claims against a school district with respect to negligent infliction of emotional distress and negligence claims brought as a result of an alleged inappropriate sexual relationship between a student and teacher.
Obtained summary disposition for physician against allegations of defamation, intentional infliction of emotional distress and breach of duties arising from physician’s involvement in custody proceeding.
Second chaired a trial resulting in a no cause of action for a physician; the plaintiff claimed she sustained injuries to the peroneal nerve as a result of an improperly performed knee surgery.
Obtained summary judgment for financial institution with regard to alleged violations of the Real Estate Settlement Procedures Act brought as a result of the foreclosure of a mortgage encumbered property.
Successfully negotiated settlement for a national retail corporation with regard to premises liability claim brought as a result of a slip and fall accident.
Assisted in the successful defense of a medical liability case against a surgeon in which the plaintiff alleged peroneal nerve injury after total knee replacement surgery. The case resulted in a verdict of no cause of action.
Assisted in the defense of a religious organization in a premises liability action with responsibility for drafting a motion for summary disposition, which led to the case ultimately being dismissed
Researched the Business Corporations Act for a case involving physicians employed by a professional corporation in order to determine if they had standing to maintain a derivative proceeding
Defended indigent clients in tax proceedings and assisted them with tax collection problems, including offers in compromise, liens, levies, et al.
