Program Description:

Like a scene from the blockbuster 80s movie “Back to the Future,” a recent ruling by the Michigan Supreme Court has sent the state back in time more than 20 years by overturning Lugo v Ameritech Corp and restoring the comparative negligence standard for premises liability cases.

The decision effectively ends the state’s “open and obvious” defense for premises liability cases that Lugo helped establish and could open the proverbial floodgates for new cases to be filed. Like Marty McFly and Doc Brown, defense attorneys are now calculating what it will take to safely return their clients Back to the Future!

This 30-minute webinar examined the Supreme Court’s ruling and discussed what the new legal landscape will require of litigants and insurance providers going forward.
