Bio

Mark W. Oszust is an attorney in the firm's Commercial Litigation and Construction Law practice groups. Mr. Oszust focuses his litigation practice in construction and real estate law, as well as in high profile and complex commercial litigation and construction disputes.

A member of Plunkett Cooney's Bloomfield Hills office, Mr. Oszust represents general contractors, subcontractors, owners and design professionals in claims involving construction disputes, additional compensation (i.e., labor inefficiencies and schedule delays), payment disputes, design defects and construction liens. He has successfully resolved numerous cases at trial.

Mr. Oszust is admitted to practice in state and federal courts in Michigan, as well as in the U.S. Court of Appeals for the Sixth Circuit and the U.S. Supreme Court. He is also a member of the State Bar of Michigan.

Representative Client Work

  • Obtained favorable rulings from the U.S. Court of Appeals for the Sixth Circuit and Michigan Court of Appeals whereby the courts held that equity in real property is a protected property right under the federal and Michigan Constitutions. See Hall v. Meisner, 51 F.4th 185, 187 (6th Cir. 2022); Jackson v. Southfield Neighborhood Revitalization Initiative, No. 361397, 2023 WL 6164992 (Mich. Ct. App. Sept. 21, 2023).
  • Successfully obtained orders summarily dismissing subcontractors’ claims for additional compensation in multiple construction disputes while representing general contractors. See Kandico Services, LLC v. Smalley Construction, Inc. (Case No. 20-013871-CB) and Nail-Rite Construction Company, Inc. v. Titan North America, Inc. (Case No. 22-009226-CB).
