Bio

The managing partner of the firm's Columbus, Ohio office, David L. Van Slyke also serves as Co-leader of the firm's Real Estate Litigation & Title Insurance Practice Group. His practice focus includes general litigation, title insurance litigation and banking and finance law.

Mr. Van Slyke’s clients include insured owners and lenders under title insurance policies and title insurance companies in escrow defalcations, coverage matters and closing protection letters. He represents corporate clients in commercial litigation, including commercial loan workouts, easement and pipeline litigation, receiverships, defense of consumer litigation, disputes as to mortgage repurchase agreements, as well as clients involved in contract and residential real estate disputes.

Mr. Van Slyke’s representation of clients has involved all phases of pleading, discovery and motion practice, trial advocacy in various state courts and briefing and argumentation in several appellate districts. He is licensed to practice in both state and federal courts in Ohio.

Representative Client Work

  • Represents mortgage-brokers/originators in disputes relative to re-purchase agreements and secondary market litigation
  • Represents sellers and/or purchasers in disputes relative to the Ohio Residential Property Disclosure Form and Real Estate Purchase Contract
  • Represents loan servicers in FDCPA, RESPA, TILA and FCRA litigation
  • Represented national title insurance company in escrow defalcation involving commingling of funds and fraudulent loan disbursements
  • Regularly represents lenders in litigation involving lien priority disputes, mortgage/lien validity, enforceability of options to purchase/rights of first refusal and mortgage fraud
  • Regularly consults and represents title insurance companies on coverage and liability issues relative to escrow/closing agent duties
  • Regularly presents commercial lenders in foreclosure/loan workout and litigation involving receiverships
  • Regularly represents interested parties in easement and pipeline enforcement litigation
