Bio

Marc P. Jerabek is a partner with expertise in financial services, real estate and business matters. An accomplished litigator, Mr. Jerabek represents financial institutions, mortgage servicers, large and small businesses, and individuals, helping them navigate legal issues and achieve the best result when facing litigation.

A member of the firm’s Banking, Bankruptcy & Creditors’ Rights Practice Group, Mr. Jerabek has extensive experience representing financial institutions. His experience includes banking and financial services litigation, commercial loan workouts and restructuring, negotiable instruments, lender liability, bankruptcy (chapters 7, 11 and 13), adversary proceedings, lien stripping cases, non-discharge of debt in bankruptcy, secured transactions, default servicing, defense of consumer claims (including RESPA, TILA, FDCPA, FCRA, TCPA, HAMP, student loan disputes and dischargeability, etc.), claim and delivery/replevin, foreclosure and collection.

Mr. Jerabek also has wide-ranging experience handling real estate matters, including landlord-tenant disputes (industrial, commercial and residential), quiet title, boundary disputes, title insurance claims and defense, leases, purchase agreements, land-contract, foreclosure, non-disclosure of defects, demolition and dangerous building proceedings, inspections and real estate litigation.

His experience also includes complex commercial litigation, business torts, contract disputes, UCC claims and sales commissions disputes, to name a few. Mr. Jerabek is also a Certified Information Privacy Professional (CIPP/US) (credentialed by the International Association of Privacy Professionals (IAPP)), representing clients in privacy, data breach, and cybersecurity matters.

In addition, Mr. Jerabek is a member of the firm’s Commercial Litigation Practice Group, where he represents businesses of all sizes in state and federal courts throughout Michigan. He is licensed in the Michigan trial and appellate courts and the U.S. trial and appellate courts in the Sixth Circuit.

Representative Client Work

  • Successfully defended energy provider against multi-million dollar sales commission claim
  • Recovered stolen/converted commercial property worth hundreds of thousands of dollars and obtained judgment against defendants perpetrating the fraud
  • Represented landlords and tenants in hundreds of landlord-tenant disputes (industrial, commercial and residential)
  • Obtained six-figure arbitration award on behalf of homeowners for defective construction of a custom-built home
  • Obtained judgment for non-discharge of debt in bankruptcy adversary proceeding trial on behalf of national lender
  • Successfully defended banks, financial institutions and mortgage servicers in hundreds of cases involving wrongful foreclosure and the alphabet-soup of claims (including RESPA, TILA, FDCPA, FCRA, TCPA, HAMP, etc.), including appeals before the Michigan Court of Appeals and the U.S. Court of Appeals for the Sixth Circuit
  • Recovered millions of dollars on behalf of banks and financial institutions in commercial loan workouts and restructurings
  • Secured six-figure recovery on behalf of precious metal investor when investment broker defaulted on security agreement
  • Jointly represented out-of-state and national businesses as local counsel in lawsuits pending in Michigan's state and federal courts
